The following Privacy Statement (“Statement”) explains to any individuals (whether visitors, customers or users, collectively “Users”, “your” or “you”) who access or use our services or products through our website (such as www.segments.ai), platform or applications (collectively, the “Services”) or who interact with Segments.ai BV (“Segments.ai”, “we”, “us”, “our” or “Company”) how we collect, store, use, process, protect and disclose your personal data across our Services. Please read this information carefully to understand how we respect and protect your privacy, what your rights and choices are with respect to your personal data and how you can contact us to learn more about our privacy practices.

1. What do we collect?

We collect the following types of personal data:

  • Identifiers: name, email address, phone number, company name, company role, username and password.
  • Categories of personal information described in Section 1798.80(e) of the California Civil Code: name, phone number, and company name.
  • Internet or other electronic network activity information: we collect information about the devices you use to access the Services (including but not limited to device type, browser type, IP address, the website leading you to our Services and any identifiers) and collect information about how you use our Services (including but not limited to tracking your activity).
  • Professional or employment-related information: company name and company role.

The categories of sensitive information include:

Account log-in information: username, password and geolocation data.

2. For which purposes and for how long will we use your data?

We use the collected personal data to provide, promote, protect and improve our Services for your benefit. This includes the processing of your data for creating and managing user accounts, organizing event (including web events), communicating with you (including newsletters), offering support. We may also process personal data in order to anonymise the data, so they are no longer personal data. Your personal data can also be processed in order to analyse the use of our Services and to improve our support and our Services.

The legal basis for these processing operations is the pursuit of our legitimate interests (i.e. offering a service, as agreed with the organization for which you are an authorized user, the improvement of our Services) or the performance of a contract (where we have an agreement with you).

We use data hosting service providers in the European Economic Area (“EEA”) to host the information we collect. In case of a transfer outside of the EEA, for whatever reasons, we take appropriate steps to follow treatment as set forth in this Statement and in accordance with the applicable law with respect to transfer and destination.

We will keep your personal data for as long as we have a valid agreement with the organization which has indicated you as an authorized user and for 10 years after the termination of that agreement. Alternatively, we will keep your personal data for as long as your account exists and for 10 years after your closed your account.

3. How do we share your personal data?

Affiliates and Service Providers. We share your personal data with our third-party service providers and any subcontractors as required to offer you our products and services. The service providers we use help us to:

  • Run, operate, and maintain our websites through third-party platforms and software tools;
  • Provide measurement services and targeted ads (you can opt out of these services at websites such as aboutads.info/choices and http://www.youronlinechoices.eu/) via Posthog for product analytics; and,
  • Provide technical and customer support via Hubspot which provides our website chat function.

Aggregated Data. We may also aggregate or otherwise strip personal data of all personally identifying characteristics and may share that aggregated, anonymized data with third parties or publish it. This data does not personally identify you and helps us to measure the success of our websites and its features and to improve your experience. We reserve the right to make use of any such aggregated data as we see fit.

Third Party Marketing and Advertising Organizations. With respect to website cookies, we share your data with third-party marketing and advertising partners to market our services on our websites and other websites that you may visit. Learn more in our Cookie Policy below.

Disclosures Required by Law. We may be required to disclose your data in response to lawful requests by public authorities, including to meet law enforcement requirements. We may be under a duty to disclose or share your personal information to comply with any legal obligation, to enforce or apply our terms and conditions and other agreements, to protect our rights, property, or safety, or to protect the rights, property, or safety of others. This includes exchanging information with other companies and organizations for the purposes of fraud protection.

4. How do we respond to ‘Do Not Track’ signals?

Some browsers provide you with a way to signal that you do not want your browsing activity to be tracked. The websites may not currently respond to all Do Not Track (“DNT”) or similar signals, as we are awaiting consensus from the Internet policy and legal community on the meaning of DNT and the best way to respond to these signals.

California residents may opt out of tracking technologies by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC) (on the browsers and/or browser extensions that support such a signal). 5. What are your data protection rights?

As data subjects, if the legal requirements are met, you have the right to request access to your personal, correction or deletion of your personal data, limitation of data processing, portability of your personal data and you have the right to object to the processing of your personal data due to your particular situation.

  • Exercise your rights or address any question related to the foregoing;
  • Stop receive marketing emails;
  • Remove your account; or

Please note that your request and choices may be limited in some situations, for example, if you require to remove information that we are permitted by law to retain.

6. Privacy rights & additional disclosures for California residents

Several jurisdictions grant state residents certain rights and disclosures. We provide the following information to further help you understand your potential privacy rights. If you would like to exercise any rights or inquire as to whether such rights are available to you, please email us at support@segments.ai.

Request for Information or Deletion. California residents have the right to know whether we are processing your personal data, and in some instances, you have the right to request that we disclose to you the categories listed below for the preceding 12 months. We have the right to request verification of your identity for all requests for information. In responding to this right, we shall provide to you:

  • The categories of personal data we collect about you.
  • The categories of sources from which your personal data is collected.
  • The business or commercial purpose(s) for collecting, selling, sharing, or disclosing your personal data, and the categories of personal data disclosed for such purpose(s).
  • The categories of third parties with whom we share your personal data.
  • The categories of personal data we have sold, if any, about you and the categories of third parties to whom your personal data was sold, by category or categories of personal data for each third party to whom the personal data was sold.
  • The specific pieces of personal data we have collected about you.

In addition, you may have the right to request we delete your personal data.

Request for Correction. California residents have the right to request the correction or rectification of inaccurate information in the resident’s personal data.

Request for Portable Data. California residents have the right to receive, in certain circumstances, a portable format of their personal data that allows the data to be transmitted to another entity.

Opting Out of Cookies and Sale/Sharing Using Online Tracking Technologies. Our use of online tracking technologies may be considered a “sale” / “sharing” under applicable law. If you do not have a Segments.ai account or if you are not logged into your Segments.ai account, your request to opt out of “sale” / “sharing” will be linked to your browser identifier only and not linked to any account information because the connection between your browser and the account is not known to us.

We do not sell your personal data. However, we may use your personal data to provide personalized or targeted advertising. In such circumstances, you may have the right to direct us not to share your personal data for such purposes.

In the preceding twelve months, we have shared the following categories of personal data relating to consumers who use our Services:

Limiting the Use of Sensitive Personal Information. Residents of California have the right to direct us to use or disclose sensitive personal data only for providing goods or services, or as otherwise minimally permitted under applicable law. We do not use or disclose sensitive personal data for any purpose other than for internal analysis to provide our goods and services to you, to personalize the content that we send to you, or as otherwise minimally permitted under applicable law.

Third Party Marketing. If you are one of our customers, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal data to third parties for the third parties’ direct marketing purposes.

We do not disclose your personal data to third parties for the third parties’ direct marketing purposes.

Right to Equal Service & Price. You have the right to receive equal service and price, even if you exercise a privacy right.

Verification Process for Exercising Rights. To protect our consumers’ privacy, we verify privacy rights requests to ensure that only you (or your authorized agent) can exercise rights pertaining to your personal data. As part of our verification process, we may request you to submit additional information.

If you are an authorized agent wishing to exercise rights on behalf of a state resident, please contact us at support@segments.ai and provide us with a copy of the consumer’s written authorization designating you as their agent. We may need to verify your identity and place of residence before completing your rights request.

Appeal Process. If we do not decide to act in response to your request to exercise a right, we will provide a timely response detailing the reasons for not taking the action and, depending on your jurisdiction, any rights that you may have to appeal our decision.
